1. Bookings
1.1
Your booking is not confirmed until you receive a booking confirmation letter or email from us.
1.2
By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.
1.3
In the event that Party Delights Photo booth is not ready to commence at the agreed time due to our fault, then we will still operate the agreed hire period by extending the finishing time of the hire (venue permitting). In the event that the hire does not start at the agreed time, as setup has been delayed due to any unforeseen circumstances that are no fault of, Party Delights Photo booth the hire will still end as per the agreed time on booking form. In the event that we have set up in time but the hire does not start at the agreed time due to over running of previous activities by you or venue, the hire will still end as per the agreed time on booking form.
1.4
Party Delights Photo booth cannot be held responsible for any circumstances that may prevent us from attending your event; these may include but are not limited to severe weather conditions, traffic delays, breakdown of our vehicles, sickness or equipment failure. In the case that we cannot attend or fulfil your hire due to events beyond our control we will contact you or the venue as soon as possible. In these instances our liability will be limited to refunding all of monies paid.
2. Prices, Deposits & Balance Payments
2.1
All hires are subject to a deposit of at least £50.00 (Deposit is non-refundable).
2.2
The remaining balance to be paid in full and cleared 14 days prior to the event start date unless otherwise agreed. If the operator uses the equipment for a time period in excess of the service period agreed, the coverage in rental time will be billed to the operator and must be paid before additional hours are provided.
2.3
Flower Wall Hire will also require a damages deposit of £150.00 with the final balance (this requires paying in full 14 days before your event) and this will be refunded in full within 48 hours of the event, subject to there being no damage incurred or loss to the Flower Wall or equipment.
2.4
Advertised prices are subject to change without prior notification.
2.5
Party Delights Photo booth reserves the right to charge interest on all overdue accounts at 2% above its banker’s current interest rate.
3. Cancellations
3.1
Any cancelled order is subject to the following cancellation charges:
Within 8 weeks prior to event 20% of order value.
Within 6 weeks prior to event 50% of order value.
Within 4 weeks prior to event 75% of order value.
Within 2 weeks prior to event 100% of order value.
Please note this does not affect your statutory rights and are entitled to a 14 day cooling off period from the date payment was made.
4. Equipment
4.1
The company reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.
4.2
All sizes quoted are approximate.
4.3
All goods remain the property of Party Delights Photo booth at all times.
4.4
The company reserve the right to amend or alter any product specifications without prior notice.
4.5
The equipment hired must be returned back in the condition they were received in. Handled with care at all times and to be treated in a respectful manner.
4.6
Unless agreed hired equipment is for indoor use only.
5. Site Location, Facilities & Conduct
5.1
Hired equipment will be set up (a minimum of one hour is required) at the pre-arranged time and will be collected at the pre-arranged time, set up in one location only as pre-arranged or on arrival and cannot be moved once set up during the hire time. Please ensure there is sufficient space at your venue to set up the equipment. We will need access to the venue at these times and clear instructions on where the equipment is to be placed. All equipment must be on a completely flat & level surface. Party Delights photo booth equipment may be located within a marquee, but please note the level surface requirements. Photo Booths require a electrical socket close to the set up point.
5.2
Please ensure that you have obtained permission at your venue to use the equipment and there is sufficient space for the equipment you are hiring.
5.3
Please inform us of any circumstances that would make setting the equipment up more demanding, including going upstairs, long distances from unloading area to venue etc. We allocate a set period of time for setting up our equipment at your venue which is included within you price, but if there are any complications that are not made known to us beforehand then unfortunately this will come out of the run time.
5.4
The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.
5.5
The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.
5.6
Party Delights Photo Booth reserves the right to refuse guests admission into the photo booth or use the hired equipment if our staff feels they are too unruly.
6. Liability & Insurance
6.1
The client agrees to cover the company for any damage or theft of the company’s equipment whilst on hire. We strongly recommend you taking out wedding insurance for such instance.
6.2
The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.
7. Discrepancies
7.1
Any discrepancies with an order must be notified within 7 days after the event. Any discrepancies that are not notified during this period will be exempt from any credit/refund. We attend multiple events a weekend so need to know as soon as possible if there was any issues/discrepancies to be able to obtain all the information required to answer any issues.
8. All other terms and conditions
8.1
Party Delights Photo booth may use any of the photographs from your event for suitable means; this includes but is not limited to advertising and promotional material either in print or on the internet. Attending your event would mean you agree and permission has been granted to do so by yourselves and your guests.
8.2
Copyright Photos & Video - Party Delights Photo Booth will own the copyright of all images and videos taken using the Photo booth. We reserve the right to send images to third parties if requested. USBs are sometimes sent to customers via postal service, Party Delights Photo Booth cannot be held responsible for Photo graphs/Video being given or sent to customer for loss or damage to the USBs in transit or at the event. After an event is completed, the photos from it are only kept on the hardware system in the booth for one month.
8.3
By hiring a photo booth/flower wall from Party Delights Photo booth means you agree to all of our Terms and Conditions.
8.4
When Guest books are provided for guests to put their second photo in the book with a message, we do actively encourage this but cannot be held responsible for guests not leaving the photo or leaving a message or leaving the photo and message in a funny position. The guest book is left mainly for guest to use throughout the night and cannot be manned by the attendant all night.
8.5
Video Option - It is usual to receive video messages from the guests however we cannot control or make people leave these messages. The button is clearly visible for the video message option.
8.6
Mechanical Problems - On the rare occasion the Photo Booth may have technical problems every effort will be made to rectify the problem. If the problem is rectified the photo booth will made available for use over the time provided, if the problem is a printer problem photos will still be taken and photos will be printed out the next working day and sent to the client. No Refund shall be given unless the Photo booth cannot take photos from a camera failure or hard drive failure.
8.7
Party Delights Photo Booth agrees to have a Photo Booth operational for a minimum of 80% during the hire period; operations may need to be interrupted for maintenance of the photo booth (eg restocking photo paper).
8.8
The flower wall is hired on a daily basis (Monday = 1 day, Tuesday = 1day, etc) not a 24 hour basis.
